May proved that the end of the real estate tax credit for buyers didn’t bring business to a halt! The month was still busy for Maumee Real Estate, Sylvania Real Estate, Toledo Real Estate and other surrounding areas, including Oregon, Northwood, Perrysburg and Holland. Be sure to make it a safe one!

Hopefully even Danberry Realtors who never seem to get a weekend off will find time this Memorial Day weekend to spend with their families. The economy of recent years has taught us a new word, “staycations”, and guess what – they can be great fun!

But if you will be among the millions of road warriors (estimated to be around 27 million of us), make it a safe one. You don’t need a checklist, just remember the basics. Stay alert behind the wheel, or take turns driving with someone who is. Buckle up, especially the little ones. And give yourself plenty of time to reach your destination. We’re all better drivers when we’re not rushed trying to make up time.

Most importantly, let’s remember what Memorial Day is all about, honoring those who laid down their lives for us and made our incredible lifestyle possible.

The next time you are in the Toledo real estate market, surely you will have expectations about how you should be treated. Great customer service, high ethical standards, effective communications – these should all be part of the service package.

But let’s be more specific.  What obligations do sellers and Realtors have to disclose problems such as property defects?  Both the states of Ohio and Michigan require sellers to fill out multi-page disclosure forms regarding the condition of their property, and these must be acknowledged by a purchaser or else the purchaser has the right to rescind the purchase agreement. 

So defects need to be disclosed, but what constitutes a “defect”?  First, it needs to be one of which the seller or licensee has knowledge. Buyer’s agents look out for their client’s best interests, but that does not include an obligation to discover latent defects.  “Material facts” (known to the seller or Realtor) need to be disclosed, so what constitutes a material fact? The best definition I’ve heard over the years is “any facts which would impact the decision of a reasonable buyer when deciding whether or not to buy, or the terms by which they buy.”  We know that buyers (and their attorneys) hate surprises, so rest assured, if a seller asks us not to disclose a known defect, The Danberry Co., Realtors will not work with them.

The Toledo Real Estate market and The Danberry Co. recently experienced a visit from the “Trendsetters”, a group of many of the nation’s best brokers, moderated by Steve Murray, perhaps the nation’s leading industry observer.  In Steve’s latest REAL Trends newsletter update, Steve states:  Spirit is alive and well. Having just spent three days in one of the hardest hit Midwest markets in the country talking with sales professionals and management of a leading brokerage firm I can say that despite all of the bad news in housing and the general economy, the strength and determination of real estate professionals is undimmed. Meeting with the leaders of The Danberry Company in Toledo, Ohio, I came away impressed with the upbeat manner in which they have dealt with the double whammy of high unemployment, distressed housing prices and lower home sales. I searched high and low for sounds of those who felt defeated but it just wasn’t there…one can’t help but be amazed at the resiliency of real estate professionals who have seen their markets decline by more than 50 percent in housing unit sales and in some cases an equal amount in the value of the homes they are selling. It bodes well for the nation when people in such beleaguered markets can be so optimistic about their business, without complaint and not worrying about what was but only what is ahead.”
